Custom Art Submission Rules and Regulations

By submitting a custom art request through the ThurmanatorX Art Custom Art Order Form, you agree to abide by the following terms and conditions. These rules and regulations govern the relationship between you ("the Client") and ThurmanatorX Art ("the Artist") regarding the creation, purchase, and ownership of custom artwork.

1. Submission of Custom Art Requests

  • All custom art requests must be submitted via the official ThurmanatorX Art Custom Art Order Form, available at https://thurmanatorx.art.
  • The Client must provide accurate and complete information regarding their vision, preferred style, size, color scheme, timeline, and any additional reference images to help guide the Artist in creating the artwork.
  • Submission of the form does not guarantee acceptance or commencement of the project. ThurmanatorX Art reserves the right to decline any project request without providing a reason.

2. Intellectual Property

  • ThurmanatorX Art retains all intellectual property rights to the artwork created, including but not limited to copyrights, even after the artwork is sold or delivered to the Client.
  • The Client may not reproduce, copy, or distribute the artwork without prior written consent from ThurmanatorX Art.
  • Custom artwork will be created based on the Client's specifications, but ThurmanatorX Art will not use copyrighted images or any unauthorized materials submitted by the Client. The Client warrants that any inspiration or reference images provided do not infringe on third-party copyrights or other intellectual property rights.

3. Revisions and Changes

  • Minor adjustments and revisions can be requested by the Client during the development process, but any significant changes that substantially alter the original request may incur additional fees.
  • ThurmanatorX Art will provide progress updates as agreed upon in the Custom Art Order Form, and revisions must be communicated promptly by the Client.

4. Timeline for Completion

  • ThurmanatorX Art will strive to meet the timeline selected by the Client, but timelines are estimates and may vary depending on the complexity of the project and other factors. Delays will be communicated to the Client in a timely manner.
  • The Client acknowledges that unforeseen circumstances, such as technical difficulties or supply chain disruptions, may affect the timeline for project completion.

5. Payments and Deposits

  • A non-refundable deposit of at least 50% of the agreed-upon total price is required before work on the project will begin.
  • The remaining balance is due upon completion of the artwork, prior to delivery or shipment. Payment must be made in full before any rights to the artwork are transferred to the Client.
  • Failure to pay the remaining balance within 30 days of the project’s completion will result in the forfeiture of the Client’s deposit and cancellation of the order.

6. Cancellations and Refunds

  • All custom art orders are final, and no refunds will be issued once the project has commenced.
  • In the event of a cancellation request by the Client before work has started, the deposit may be forfeited at the discretion of ThurmanatorX Art.
  • ThurmanatorX Art reserves the right to cancel the project at any time and provide a prorated refund of any payments made if the Artist is unable to complete the project.

7. Delivery and Shipping

  • The Client is responsible for providing accurate delivery or shipping information.
  • Shipping fees, if applicable, will be the responsibility of the Client and will be added to the final invoice.
  • ThurmanatorX Art is not responsible for delays caused by third-party shipping providers or customs clearance issues.

8. Liability and Disclaimer

  • ThurmanatorX Art is not liable for any damages, including but not limited to, direct, indirect, incidental, or consequential damages that may arise from the creation or delivery of the artwork.
  • Any materials or images submitted by the Client for use in the artwork must be free of any third-party intellectual property claims. The Client assumes full responsibility for any legal claims arising from the use of such materials.
  • ThurmanatorX Art does not guarantee that the final product will meet the Client’s exact expectations, as artistic interpretation and variation are inherent in custom art creation.

9. Governing Law and Dispute Resolution

  • These terms and conditions shall be governed by and construed in accordance with the laws of the state in which ThurmanatorX Art is based.
  • Any disputes arising out of or in connection with these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • The Client agrees to waive any right to a trial by jury or to participate in a class action lawsuit.
